E Visas

The E-1 and E-2 visas are non-immigrant visa categories available to individuals from countries that have established treaties of friendship, commerce, and navigation with the United States. 

What are the eligibility requirements for the E-1 Visa?

  • More than 50% of the trade must take place between the U.S. and the treaty country.
  • The applicant can be an independent trader, a company employee, or an agent engaged in trade activities.
  • The applicant must own at least 50% of the company involved in the trade.
  • The trade activities may include the buying, selling, or exchange of goods, services, or technology.

What are the eligibility requirements for the E-2 Visa?

  • Nationality: The applicant must be a citizen of a country that maintains a treaty of commerce and navigation with the U.S.
  • Investment: The applicant must have made, or be in the process of making, a significant financial investment in a U.S. enterprise. The investment should be enough to support the visa holder and their family within five years.
  • Business Type: The business must be a active, for-profit entity with a realistic potential for growth and profitability.
  • Source of Funds: The investment capital must be derived from lawful sources

H Visas

  • H-1B Visa

The H-1B visa is a nonimmigrant visa that allows U.S. employers to hire foreign professionals in specialty occupations requiring at least a bachelor’s degree or its equivalent.

Requirements for an H-1B1 Visa:

  1. Certification from the Department of Labor.
  2. Bachelor’s degree – Experience may substitute for incomplete education.
  3. Wage Compliance
  • H-1B2 Visa

The H-1B2 visa is designated for foreign nationals who temporarily come to the United States to provide specialized services in connection with research and development projects funded or overseen by the Department of Defense.

  • H-1B3 Visa

The H-1B3 visa is available to foreign nationals seeking to work in the U.S. as fashion models. Applicants must have a recognized reputation for their expertise, accomplishments, and skills in the fashion industry, both nationally and internationally.

  • H-2A

It allows U.S. agricultural businesses to hire noncitizens for seasonal or temporary work in farming and related industries. To qualify for H-2A classification, employers must meet a number of essential requirements, including:

  1. Temporary or Seasonal Nature of the Job
  2. Unavailability of U.S. Workers
  3. Protection of U.S. Worker Wages and Working Conditions
  4. Labor Certification from the U.S. Department of Labor
  • H-3

The H-3 visa allows individuals to temporarily come to the U.S. for training in specific fields or to participate in a Special Education Exchange Visitor program.

  • H-4

The H-4 visa allows dependents (spouses and unmarried children under 21) of certain visa holders to join them in the U.S.

Eligibility:

  • Available to dependents of H-1B, H-1B1, H-2A, H-2B, and H-3 visa holders.
  • Dependents can study full-time or part-time but cannot work.
  • Certain H-4 spouses may be eligible for employment authorization.

J Visas

The J-1 visa is for individuals participating in approved exchange programs to teach, study, research, receive training, or gain medical education. That includes:

  • Professors, scholars, and research assistants
  • Students, teachers, and specialists
  • Au pairs and camp counselors

J-1 visa holders maintain their status by fulfilling program requirements and can extend their stay through their sponsor.

Spouses and unmarried children under 21 (J-2) are eligible to join, and J-2 dependents may work with authorization, though their income cannot support the J-1 visa holder.

L Visas

The L-1 visa allows employees of multinational companies to work temporarily in the U.S. after being transferred to a U.S. office.

What are the eligibility requirements ?

  • The employee must qualify to work in the U.S.
  • The employer must have a qualifying relationship with a foreign company and conduct business in the U.S. and at least one other country.

L-1 visas are typically valid for 3 months to 5 years, with a maximum stay of 7 years with extensions.

What about your spouse and your children?

Dependents of L-1 visa holders can apply for L-2 visas to join the principal visa holder in the U.S. While in the country, L-2 spouses and children may also be eligible to apply for work authorization.

O Visas

The O-1 visa is for individuals with extraordinary ability or achievement in fields such as science, arts, education, business, or athletics, or those recognized for exceptional accomplishments in the motion picture or television industry.

Types of O-1 visas:

  • O-1A: For individuals with extraordinary ability in sciences, education, business, or athletics (excluding arts and entertainment).
  • O-1B: For individuals with extraordinary ability in the arts or exceptional achievement in the motion picture or television industry.
  • O-2: For individuals accompanying O-1 visa holders to assist in a specific event or performance.
  • O-3: For spouses and children of O-1 and O-2 visa holders.

Initial Stay:
O-1 visa holders are granted an initial stay of up to 3 years, with the possibility of extensions based on the nature of their work.

TN Visas

The TN visa, also known as the NAFTA Professional visa, allows qualified citizens of Canada and Mexico to work temporarily in the United States in specific professional roles.

Eligibility Requirements

  • Be a citizen of Canada or Mexico
  • Your profession must be on the list of eligible occupations under the USMCA (such as accountants, engineers, lawyers, pharmacists, scientists, and teachers)
  • The job in the U.S. must require a NAFTA professional
  • You must have a prearranged job with a U.S. employer (self-employment is not permitted)
  • You must have the qualifications to perform the job in the specified profession

Dependents of TN Visa Holders

Spouses and unmarried children under the age of 21 may be eligible for TD status to accompany or follow the TN visa holder. While TD dependents are not allowed to work, they can study in the U.S. Their TD status will be tied to the length of the principal TN visa holder’s stay.
